1A. General travel conditions of the Travel Disputes Committee for package travel agreements

Yankho – 4everconnected is a recognized and insured travel agency. We are insured against insolvency for the protection of the consumer with the Travel Guarantee Fund (www.gfg.be). Yankho – 4everconnected also acknowledges the authority and the general travel conditions of the Travel Disputes Commission.

 

Article 1: Scope
These general conditions apply to package travel agreements that are booked from July 1, 2018, and are governed by the Law concerning the sale of package travel, linked travel arrangements, and travel services of November 21, 2017.

 

Article 2: Information from the organizer and reseller before the conclusion of the package travel agreement
2.1
The organizer and also the reseller provide the traveler with the legally prescribed standard information before the traveler is bound by a package travel agreement, as well as, where applicable to the package travel:
1° the main characteristics of the travel services:
a) the travel destination(s), the route and the periods of stay, with the dates and the number of nights;
b) the means of transport, their characteristics and categories, the places and dates and times of departure and return, the duration and location of stopovers and connections; if the exact time is not yet fixed, this will be communicated approximately
c) the location, the main characteristics and the category of the accommodation according to the regulations of the destination country;
d) the provided meals;
e) the visits, excursions, or other services included in the agreed total price for the package travel;
f) if not clear, clarification as to whether the travel services are provided to the traveler as a member of a group;
g) the language in which other tourist services will be performed if applicable;
h) whether the trip is generally suitable for persons with reduced mobility;
2° the total price of the package travel, and where applicable, an indication of the type of additional costs that may be incurred by the traveler;
3° the payment modalities;
4° the minimum number of persons required for the execution of the package travel and the deadline for any possible cancellation of the agreement if this number is not reached;
5° general information on passport and visa requirements in the destination country, including the approximate time required to obtain a visa and information on health formalities;
6° the indication that the traveler can terminate the agreement against payment of a termination fee;
7° information on cancellation and/or assistance insurances.
2.2
The professional ensures that the correct standard information form is provided to the traveler.
2.3
The pre-contractual information provided to the traveler forms an integral part of the package travel agreement. It cannot be changed unless mutually agreed upon by the parties.

 

Article 3: Information from the traveler
3.1
The person who concludes the package travel agreement must provide the organizer and the reseller with all useful information about themselves and their fellow travelers that may be relevant for the conclusion or execution of the agreement.
3.2
If the traveler provides incorrect information and this leads to additional costs for the organizer and/or reseller, those costs may be charged.

 

Article 4: The package travel agreement
4.1
Upon concluding the package travel agreement or within a reasonable period, the organizer or, if a reseller is involved, the latter provides the traveler with a confirmation of the agreement on a durable medium, such as an email, a paper document or a pdf.
If the package travel agreement is concluded in the simultaneous physical presence of the parties, the traveler has the right to request a paper copy.
4.2
The package travel agreement or its confirmation contains the full content of the agreement, including all the information as mentioned in article 2 and the following information:
1° the special requests of the traveler that the organizer has agreed to;
2° that the organizer is liable for the proper performance of the package travel and has an obligation to provide assistance;
3° the name and contact details of the entity responsible for protection in case of insolvency;
4° the name, address, telephone number, email address of the local representative of the organizer or another service in case the traveler is in difficulty or wishes to complain about possible non-compliance;
5° the obligation of the traveler to report non-compliance during the trip;
6° information on how to directly contact an unaccompanied minor or the person responsible for them at their place of stay;
7° information about internal complaint handling;
8° information about the Travel Disputes Commission and the EU platform for online dispute resolution;
9° information on the traveler's right to transfer their agreement.
4.3
In good time before the start of the package travel, the organizer provides the traveler with:
1° the necessary receipts
2° the vouchers and travel documents
3° information on the planned departure times and, if applicable, the latest time to check-in, the planned times of stopovers, connections, and arrival.

 

Article 5: The price
5.1
After concluding the package travel agreement, prices can only be increased if the agreement expressly provides for this. In that case, the package travel agreement indicates how the price revision is calculated.
Price increases are only allowed as a direct result of changes in:
1° the price of passenger transport due to increased fuel costs or other energy sources, or
2° the level of taxes or fees for the included travel services in the agreement, which are levied by third parties not directly involved in the execution of the package travel, including tourist taxes and departure or arrival taxes at ports and airports, or
3° the exchange rates relevant to the package travel.
If a price increase is foreseen, the traveler has the right to a price reduction in case of a decrease in the above-listed costs.
5.2
If the increase exceeds 8% of the total price, the traveler may terminate the agreement without a termination fee.
5.3
A price increase is only possible if the organizer notifies the traveler no later than twenty days before the start of the package travel via a durable medium, such as an email, a paper document or a pdf, providing a justification for the price increase and a calculation.
5.4
In case of a price reduction, the organizer has the right to deduct administrative expenses from the refund owed to the traveler. If the traveler requests it, the organizer substantiates those costs.

 

Article 6: Payment of the travel sum
6.1
Unless otherwise agreed, the traveler pays a portion of the total travel sum as a deposit when concluding the package travel agreement, as specified in the special conditions.
6.2
Unless otherwise agreed in the package travel agreement, the traveler pays the balance of the price no later than 90 days before the departure date.
6.3
If the traveler, after being notified in advance, fails to pay the deposit or the travel sum required from them, the organizer and/or reseller will have the right to terminate the agreement with the traveler by operation of law, with the costs borne by the traveler.

 

Article 7: Transferability of the package travel agreement
7.1
The traveler can transfer the package travel agreement to a person who meets all the conditions that apply to that agreement, provided that they:
1° notify the organizer and possibly the reseller as soon as possible and no later than 7 days before the start of the package travel via a durable medium, such as an email, a paper document or a pdf, and
2° bear any additional costs resulting from the transfer.
7.2
The person transferring the package travel and the person taking over the agreement are jointly and severally liable for the payment of the remaining amount and any additional fees resulting from the transfer. The organizer informs the person transferring the agreement of the transfer costs.

 

Article 8: Other changes by the traveler
If the traveler requests another change, the organizer and/or the reseller may charge all costs incurred as a result.

 

Article 9: Change by the organizer before departure
9.1
The organizer can unilaterally change the provisions of the package travel agreement, with the exception of price changes, before the start of the package travel, unless:
1° the organizer has reserved this right in the agreement, and
2° it concerns an insignificant change, and
3° the organizer informs the traveler of this via a durable medium, such as an email, a paper document or a pdf.
9.2
If, before the start of the trip, the organizer finds it necessary to make a significant change to one of the main characteristics of the travel services or cannot meet the confirmed special requests of the traveler, or proposes to increase the price of the package travel by more than 8%, the organizer must inform the traveler of this and notify him:
1° of the proposed changes and their effect on the price of the package travel;
2° of the possibility to terminate the agreement without costs, unless he accepts the proposed changes;
3° of the period within which he must notify the organizer of his decision;
4° of the fact that if he does not explicitly accept the proposed change within the specified period, the agreement will be automatically terminated, and
5° where applicable, of the proposed alternative package travel and its price.
9.3
When the changes to the package travel agreement or the alternative package travel result in a reduction in the quality or costs of the package travel, the traveler is entitled to an appropriate price reduction.
9.4
If the package travel agreement is terminated on the basis of Article 9.2 and the traveler does not accept an alternative package travel, the organizer will refund all amounts paid by the traveler no later than fourteen days after the agreement is terminated.

 

Article 10: Termination by the organizer before departure
10.1
The organizer may terminate the package travel agreement:
1° if the number of persons registered for the package travel is less than the minimum number specified in the agreement and the traveler is informed by the organizer of the termination of the agreement within the period specified in the agreement, but no later than:
a) twenty days before the start of the package travel for trips lasting more than six days;
b) seven days before the start of the package travel for trips lasting between two and six days;
c) 48 hours before the start of the package travel for trips lasting less than two days, or
2° if he cannot perform the agreement due to unavoidable and extraordinary circumstances and he informs the traveler of the termination of the agreement before the start of the package travel.
10.2
In these cases, the organizer will refund all amounts received for the package travel to the traveler without being liable for any additional compensation.

 

Article 11: Termination by the traveler
11.1
The traveler can terminate the package travel agreement at any time before the start of the package travel. Upon termination, the traveler may be required to pay a termination fee to the organizer.
The package travel agreement may specify standardized termination fees based on the time of termination before the start of the package travel and the expected cost savings and income from alternative use of the travel services.
If no standardized termination fees have been established, the amount of the termination fee corresponds to the price of the package travel minus the cost savings and income from alternative use of the travel services.
11.2
However, if unavoidable and extraordinary circumstances occur at the destination that have significant consequences for the performance of the package travel or that have significant consequences for the passenger transport of the travelers to the destination, the traveler has the right to terminate the package travel agreement without paying a termination fee. In case of termination of the package travel agreement on the basis of this article, the traveler is entitled to a full refund of all amounts paid for the package travel, but cannot claim additional compensation.
11.3
The organizer will refund all amounts paid by or on behalf of the traveler, minus the termination fee, no later than fourteen days after termination.

 

Article 12: Non-conformity during the trip
12.1
The traveler must inform the organizer without delay of any non-conformity that he has established during the performance of a travel service included in the package travel agreement.
12.2
If one of the travel services is not performed in accordance with the package travel agreement, the organizer will remedy this non-conformity, unless:
1° it is impossible, or
2° it involves disproportionate costs, taking into account the degree of non-conformity and the value of the travel services concerned.
If the organizer does not remedy the non-conformity, the traveler is entitled to a price reduction or compensation in accordance with Article 15.
12.3
If the organizer does not remedy the non-conformity within a reasonable period set by the traveler, the traveler has the opportunity to do so himself and to request reimbursement of the necessary expenses. It is not necessary for the traveler to set a period if the organizer refuses to remedy the non-conformity, or if an immediate solution is required.
12.4
If a significant part of the travel services cannot be performed, the organizer will offer, without additional costs for the traveler, other arrangements of, if possible, equivalent or higher quality.
If the other proposed arrangements result in a package travel of lower quality, the organizer will grant the traveler an appropriate price reduction.
The traveler can only reject the other proposed arrangements if they are not comparable to what was agreed in the package travel agreement, or if the granted price reduction is insufficient.
12.5
If the non-conformity has significant consequences for the performance of the package travel and the organizer has not remedied it within a reasonable period set by the traveler, the traveler may terminate the package travel agreement without paying a termination fee and, where applicable, request a price reduction and/or compensation. If the package travel includes passenger transport, the organizer also provides for the repatriation of the traveler.
If no other arrangements can be proposed or the traveler rejects the other proposed arrangements, the traveler, where applicable, is also entitled to a price reduction and/or compensation without terminating the package travel agreement.
12.6
If, due to unavoidable and extraordinary circumstances, it is not possible to ensure the return of the traveler as agreed in the package travel agreement, the organizer will bear the costs of the necessary accommodation, for a maximum of three nights per traveler.
12.7
The limitation of costs referred to in 12.6 does not apply to persons with reduced mobility, to persons accompanying them, to pregnant women, to unaccompanied minors, and to persons requiring specific medical assistance, provided that the organizer was informed of their special needs at least 48 hours before the start of the package travel.
12.8
The organizer cannot invoke unavoidable and extraordinary circumstances to limit liability if the carrier involved cannot invoke it under the applicable Union law.
12.9
The traveler can address messages, requests, or complaints related to the performance of the package travel directly to the reseller from whom he purchased the package travel. The reseller will forward these messages, requests, or complaints to the organizer without delay.

 

Article 13: Liability of the traveler
The traveler is liable for the damage that the organizer and/or reseller, their appointees and/or representatives incur due to his fault, or when he has not fulfilled his contractual obligations.

 

Article 14: Liability of the organizer and the professional
14.1
The organizer is liable for the performance of the travel services included in the package travel agreement, regardless of whether these services are provided by the organizer or by other travel service providers.
14.2
If the organizer is established outside the European Economic Area, the obligations for organizers apply to the reseller established in a Member State, unless the reseller proves that the organizer meets the conditions prescribed by the law of November 21, 2017.

 

Article 15: Price reduction and compensation
15.1
The traveler is entitled to an appropriate price reduction for any period during which there was non-conformity of the provided services, unless the organizer proves that the non-conformity is attributable to the traveler.
15.2
The traveler is entitled to appropriate compensation from the organizer for any damage he incurs as a result of non-conformity. The compensation will be paid without delay.
15.3
The traveler is not entitled to compensation if the organizer proves that the non-conformity is attributable to:
1° the traveler;
2° a third party not involved in the performance of the travel services included in the package travel agreement, and the non-conformity could not be foreseen or prevented, or
3° unavoidable and extraordinary circumstances.

 

Article 16: Obligation to Assist

16.1

The organizer shall provide appropriate assistance without delay to the traveler in difficulty, in particular by: 1° providing useful information on medical services, local authorities, and consular assistance; 2° assisting the traveler with remote communications and finding alternative travel arrangements.

16.2

If the difficulties are the result of the traveler's intent or negligence, the organizer may request compensation for this assistance. This compensation shall not exceed the actual costs incurred by the organizer.

 

Article 17: Complaints Procedure

17.1

If the traveler has a complaint before departure, they must report it to the organizer or reseller as soon as possible in an evidence-based manner.

17.2

Complaints during the execution of the package travel contract must be reported by the traveler as soon as possible on the spot, in an appropriate and evidence-based manner, to the organizer or reseller, so that a solution can be sought.

17.3

If a complaint is not satisfactorily resolved on site or if the traveler is unable to formulate a complaint on site, they must submit a complaint in an evidence-based manner to the organizer or reseller without delay after the end of the travel contract.

 

Article 18: Conciliation Procedure

18.1

In case of a dispute, the parties must first seek an amicable settlement among themselves.

18.2

If this attempt at an amicable settlement fails, any of the parties involved may request the non-profit organization Travel Dispute Committee to initiate a conciliation procedure. All parties must agree to this.

18.3

For this purpose, the secretariat will provide the parties with a conciliation regulation and a "conciliation agreement."

18.4

In accordance with the procedure described in the regulation, an impartial conciliator will then contact the parties to seek an equitable conciliation between them.

18.5

Any agreement reached will be recorded in a binding written agreement.

 

Article 19: Arbitration or Court

19.1

If no conciliation procedure is initiated or if it fails, the claiming party may, if desired, initiate an arbitration procedure with the Travel Dispute Committee or bring the case before the court.

19.2

The traveler can never be forced to accept the competence of the Travel Dispute Committee, neither as a claiming party nor as a defending party.

19.3

The organizer or reseller, as the defending party, can refuse arbitration only if the amount claimed by the claiming party exceeds €1,250. They have a period of 10 calendar days from receipt of the registered letter or email with acknowledgment of receipt indicating that a file with a claim starting from €1,251 has been opened with the Travel Dispute Committee.

19.4

This arbitration procedure is governed by a dispute regulation and can only be initiated after a complaint has been submitted to the company itself and it is established that the dispute could not be resolved amicably, or as soon as 4 months have passed after the (planned) end of the trip (or possibly from the service that gave rise to the dispute). Disputes concerning bodily injuries can only be settled by the courts.

19.5

The paritarily composed arbitration board will issue a binding and final decision on the travel dispute in accordance with the dispute regulation. There is no appeal possible against this decision.

Article 1: Scope
These general conditions apply to the sale of travel services booked from July 1, 2018, and are governed by the Law concerning the sale of package travel, linked travel arrangements, and travel services of November 21, 2017.

 

Article 2: Information to the traveler before a travel service agreement is concluded
The organizer or reseller acting as an intermediary for selling a separate travel service provides the traveler with the following information:
1. The main characteristics of the travel service
2. The identity of the company (company number, trade name, address, and phone number)
3. The total price of the travel service
4. Payment terms
5. Information on internal complaint handling
6. The protection they can claim in case of insolvency
7. The name of the entity responsible for that protection and its contact details.

 

Article 3: Information by the traveler
3.1: The person concluding the travel service agreement must provide the organizer and the reseller with all useful information about themselves and their fellow travelers that may be relevant to the conclusion or execution of the agreement.
3.2: If the traveler provides incorrect information and this leads to additional costs for the organizer and/or reseller, those costs may be charged.

 

Article 4: Insolvency
4.1: The organizer or reseller acting as an intermediary for selling separate travel services provides a guarantee for the repayment of all amounts they receive from or on behalf of travelers, in case the travel service cannot be provided due to insolvency.
4.2: Refunds for non-executed travel services are made without delay at the traveler's request.

 

Article 5: Complaints Procedure
The organizer and/or reseller provides the traveler with information on internal complaint handling.

 

Article 6: Conciliation Procedure
6.1
In case of a dispute, the parties must first seek an amicable settlement among themselves.
6.2
If this attempt at an amicable settlement fails, any of the parties involved may request the non-profit Travel Dispute Commission to initiate a conciliation procedure. All parties must agree.
6.3
To this end, the secretariat will provide the parties with a conciliation regulation and a “conciliation agreement.”

7.4
This arbitration procedure is governed by a dispute regulation and can only be initiated after a complaint has been submitted to the company itself and it is established that the dispute could not be resolved amicably or as soon as 4 months have passed after the (planned) end of the trip (or possibly from the service that gave rise to the dispute). Disputes concerning bodily injuries can only be settled by the courts.
7.5
The paritarily composed arbitration board will issue a binding and final decision on the travel dispute in accordance with the dispute regulation. There is no appeal possible against this decision.

2. Standard information form (only applicable for package travel agreements)

The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302, transposed by the Act of 21 November 2017 on the sale of package travel, linked travel arrangements and travel services.
Consequently, you can claim all EU rights that apply to package travel. Yankho – 4everconnected is fully responsible for the proper execution of the entire package travel.
Yankho – 4everconnected also has the legally required protection to refund you and, where transport is included in the package, to repatriate you in the event that it becomes insolvent.


Basic rights under Directive (EU) 2015/2302
– Before concluding the package travel contract, the traveller will receive all essential information about the package.
– The liability for the proper performance of all travel services included in the agreement always rests with at least one professional.
– The traveller will be given an emergency telephone number or details of a contact point through which he can contact the organiser.
– The traveller may transfer the package to another person, subject to a reasonable period of time and possibly against payment of additional costs
– The price of the package may only be increased if specific costs increase (for example fuel prices), if this is expressly included in the contract, and in any event no later than twenty days before the start of the package. If the price increase is higher than 8% of the price of the package, the traveller may terminate the contract. If the organiser reserves the right to a price increase, the traveller is entitled to a price reduction if the relevant costs would decrease.
– If any of the essential elements of the package, other than the price, are changed significantly, the traveller may terminate the contract without paying any termination fee and will receive a full refund. If the professional responsible for the package cancels the package before the start of the package, the traveller is entitled to a refund and, where appropriate, compensation.
– The traveller may terminate the contract without paying any termination fee before the start of the package in exceptional circumstances, for example if there are serious security problems at the destination which are likely to affect his package.
– In addition, the traveller may cancel the agreement at any time before the start of the package tour against payment of an appropriate and justified cancellation fee.
– If, after the start of the package, significant elements of the package cannot be provided as agreed, suitable alternative arrangements must be offered to the traveller at no extra cost. If the services are not performed in accordance with the contract and this has a significant impact on the performance of the package and the organiser has not remedied the problem, the traveller may terminate the package travel contract without paying a termination fee.
– In the event of travel services that have not been performed or have not been performed properly, the traveller is also entitled to a price reduction and/or compensation.
– The organizer is obliged to provide assistance to travelers in difficulty.
– If the organiser or the reseller becomes insolvent, the amounts paid will be refunded. If the organiser or, if applicable, the reseller becomes insolvent after the start of the package and transport is included in the trip or holiday, repatriation of the traveller will be arranged. Yankho – 4everconnected has taken out insolvency protection with the Travel Guarantee Fund. If services are not provided due to the insolvency of Yankho – 4everconnected, travellers can contact this entity or, if applicable, the competent authority (Kalkoven 5 b202, 1820 Steenokkerzeel, Belgium, info@gfg.be , +32-(0)2/240.68.00).

3. Special travel conditions Yankho – 4everconnected

The following special travel conditions are an integral part of the package travel agreement concluded between the traveler and Yankho and apply to all trips booked from xx/xx/xx.

 

Article 1: Prices
The agreed price in the package travel agreement is fixed and includes all mandatory services, except those which, due to local regulations, can only be paid in cash by the traveler on site, unless there is an obvious material error.
Prices are always per person unless otherwise stated.
Not included are: costs for passport, visa, vaccinations, insurance, all personal expenses, tips, and excursions not expressly indicated as included.
Prices provided over the phone by Yankho are always provisional. Only written price confirmations are valid.
Prices are calculated based on the rates and exchange rates for accommodation and other services abroad that apply at the date of reservation; on transportation rates known at the date of reservation. If a revision is necessary, it will be applied proportionally to the part of the trip subject to revision.

Article 2: Formalities
The traveler must take note of the information regarding the formalities to be fulfilled that are communicated in the brochure, on the website, via a quote, or by the travel agent/reseller. They must possess valid (not expired) identity documents for the reserved trip. The international passport must be valid for at least 6 months after the planned return. They must also obtain the necessary visas if needed. Travelers who are not of Belgian nationality must spontaneously disclose their nationality. Travelers with another nationality should seek information from their respective embassies. For any complications, Yankho-4everconnected disclaims all responsibility.
Children must have an identity card with a photo. Children not accompanied by their parents must present documents indicating the parents' consent to travel alone, including the date of arrival and departure from the concerned country, as well as the address where they will stay and their address in Belgium.
Failure to comply with the legal requirements of the concerned country is the traveler's responsibility.
The traveler must ensure that necessary vaccinations are obtained. As the organizer has no medical authority, the traveler should evaluate the provided information with a qualified doctor.
Pets can be taken on the trip provided they comply with the specific guidelines provided by the organizer. They must be in compliance with vaccination regulations. The organizer accepts no responsibility for any damage or difficulties arising from taking pets.

 

Article 3: Luggage
In case of loss or damage to luggage, the traveler must fill out a property irregularity report at the lost luggage department of the airport. Without this document, it is impossible to obtain compensation from the external party. For transport by coach, a certificate must be requested from the accompanying staff member. For transport by ferry, a certificate must be requested from the respective ferry company.

 

Article 4: Schedules
The mentioned schedules are indicative. The traveler must consider that these can change before and during the trip under all circumstances. Flight times and routes are, as also indicated on your booking confirmation, always provisional and subject to change. This rule applies even after receiving the flight tickets or travel documents. Such changes do not entitle a refund or price adjustment.

 

Article 5: Registration, Cancellation, and Changes
Anyone registering other participants is responsible for compliance with the General and Special Conditions by the persons they have registered.
Cancellation fees vary depending on the time of cancellation. These also apply when the trip is not yet guaranteed. The exact date of cancellation is determined by the date of receipt by the organizer. If the cancellation or change is forwarded on a Saturday, Sunday, or public holiday, it is only opposable to the organizer on the next working day. The cancellation of a reserved trip is only legally valid if Yankho – 4everconnected has received written confirmation of it. The following cancellation fees apply if the cancellation is requested by the traveler. In applying the percentages, the minimum fee is € 50 per person.
5a. Cancellation fee for a customized individual trip: 100% of the trip cost.
5b. Cancellation fee for group travel: up to 90 days before departure: 40% of the total trip cost (deposit); from 90 to 60 days before departure: 70% of the trip cost; less than 60 days before departure or in case of no-show: 100% of the trip cost.
Changes to a booked trip are accepted upon payment of a change fee. Minor changes (e.g., license plate, typo in the name, ordering an excursion, etc.) up to 45 days before departure: € 35 per file, possibly increased by the change fee charged according to the suppliers' sales conditions. From 44 days before departure, the cancellation conditions apply. Changes to ferry and plane tickets are carried out to the extent that this is accepted by the ferry and airline companies. If they do not allow changes, Yankho – 4everconnected cannot be held liable, and the traveler must pay the full price of the new ticket. For a change of name, accommodation, means of transport, or travel period, the cancellation conditions apply.
The premiums for cancellation insurance are not refundable.
For certain trips, different cancellation conditions may apply. If so, these adapted conditions are mentioned with the trip itself on our website and/or on your order form. If nothing is mentioned there, the normal cancellation conditions apply. If you participate in or organize a customized group trip or incentive and wish to cancel it, the conditions communicated by the Travel Designer upon booking apply.
The traveler acknowledges being properly informed about the exceptional circumstances caused by the coronavirus crisis, which may affect their trip, and about the pandemic situation at their travel destination. They have also taken note of the current travel advisories from the Belgian Foreign Affairs. The traveler therefore declares to be fully aware of the potential risks and confirms having been sufficiently informed by the travel organization.

 

Article 6: Payment of Your Trip
Payment of your deposit and balance must be made by the specified due date indicated on your confirmation (order form) or invoice.
We apply a deposit of 40% of the total trip cost, excluding the concluded insurances. These are included 100% in the deposit amount.
The balance must be paid 60 days before departure.
Any invoice/order form not protested by registered mail within 3 days of receipt is considered definitively accepted.
All invoices/order forms are payable in cash, no later than the due date indicated on the invoice/order form. The sending of the invoice/order form serves as a reminder for payment.
In case of non-payment of the whole or part of the price, the provisions of Book XIX of the Economic Law Code apply, and Yankho – 4everconnected will send the customer a free reminder to pay the amount due within 14 calendar days. If the customer does not pay within that period, the outstanding amount will be increased by an annual interest calculated at the reference interest rate plus eight percentage points referred to in Article 5, second paragraph, of the law of 2 August 2002 concerning the fight against late payment in commercial transactions, calculated from the calendar day following the day on which the free reminder was sent to the customer. Additionally, a flat-rate compensation of 20 euros plus 5% of the amount due will be charged. The flat-rate compensation can be a maximum of € 2,000.
In case of late payment of the balance, the organizer, after a formal notice to the registrant, has the right to terminate the package travel agreement and apply the contractual cancellation conditions.

Article 7: Complaints Procedure
The traveler must promptly inform the organizer, in an evidence-based manner, of any non-conformity they experience during the execution of the package travel agreement. Any complaints must be submitted in writing to Yankho – 4everconnected no later than 14 days after the trip.
The equivalent of any services not received will only be refunded upon submission of a written certificate from the relevant service provider clearly stating which services the traveler did not receive.
For any disputes that cannot be resolved through the Travel Dispute Committee, only the Dutch-speaking court of first instance in Brussels and the justice of the peace in Meise have jurisdiction. All obligations undertaken with Yankho – 4everconnected are governed by Belgian law.

 

Article 8: Offer
The offer/information in our brochures, newsletter, on our website, and social media is made in good faith based on the information available at that time.

Article 9: Right of Withdrawal
You can exercise your right of withdrawal for a remote purchase (e.g., via the internet) within 14 calendar days. This right of withdrawal does not apply to online booking of trips. 4. General Information Yankho – 4everconnected

Hotels & Accommodation
When the mentioned hotels or accommodations are no longer available, alternatives will be proposed, the route itself will not or minimally change. In case of price changes, this will first be presented to the customer. Our prices are not valid during fairs and congresses.

 

Room Distribution
For a group trip and where applicable, different rooms will be booked well before departure for the group. The exact room distribution may vary per trip and can be consulted on the page of the respective group trip. If the traveler cannot find this information on the website page or wants more information about the exact room distribution for a specific trip, they can request this information via email. Registering in a duo, family group, or any other group does not imply that they have more right to a specific type of room (e.g., double room) compared to solo travelers. The room distribution during a group trip happens at the location itself, and each participant has an equal right to sleep in a specific type of room as any other traveler. In mutual consultation, rooms are divided daily in the fairest possible way. If the traveler wants a separate room for themselves or their travel group, they must request this via email before the trip's departure and pay a supplement. This is not possible for all group trips and is always on request.

 

Damage to Rented Equipment
Costs resulting from damage or breakage to rented equipment from our partners can be charged to the customer.

 

Flights – Group Trips
If round-trip flights are included in a group trip, they will be arranged from Belgium (20 kg checked luggage and 7 kg hand luggage included). As a traveler on a group trip, you cannot choose the departure airport.

 

Important Note for All Air Tickets
If the trips are offered including a flight, it is immediately checked upon booking whether the mentioned price class is still available. If no longer available, travel can only be done by paying a supplement. According to the conditions of the respective airline, tickets may or may not need to be issued immediately. If so, you must fully pay for the tickets at the time of reservation. Any increase in airport tax and/or a fuel surcharge after reservation will be automatically charged.

 

Car Rental – Camper Rental
When picking up the car (i.e., the mentioned car brand/type or an equivalent alternative), a contract is made between the customer and the rental company, and you must present a valid credit card, your ID card, and a driver's license that is at least 1 year old. The credit card serves as a guarantee and will be used for payment of additional insurance, GPS usage, toll roads, etc. Without a valid credit card in the driver's name (main booker), you will not receive the rental car. A prepaid card or a card without embossing is not valid! Our prices are calculated for picking up (“pick up”) and returning (“drop off”) the car at the agreed place and time. If the pickup and return location differ, a supplement, depending on the distance, must be paid. In case of late return of the car, an extra daily rate will be charged. If cross-border rental is involved, you must certainly report this when picking up the car. Sometimes an extra cost must be paid locally for this. The minimum age of the driver is 19 - 25 years, depending on the car type and destination. In the event of an accident/theft, there is an ‘own risk’ amount that depends on the car type and destination. At most locations, you can take out a Super CDW at the car pick-up, which can significantly reduce this amount. This is usually not applicable for drivers under 25 years old.

 

Ferry Trips
The ferry prices are calculated based on the 'flex' car package offered by the ferry companies. If this is no longer available at booking, the price may change.

 

Hotel Taxes
Note: we have calculated the prices in our brochure and on our website according to the taxes applicable at that time. If any of the respective governments decide to increase this tax, we are forced to pass on this increase proportionally.

 

Before Booking
Make sure that before booking a trip, you are aware that Yankho – 4everconnected does not offer risk-free excursions or package trips along well-trodden paths. It often involves expeditions in countries that experience very extreme seasons and are therefore always adventurous. We consciously use the word “expeditions” to describe some of our experiences. This is a conscious choice, as an expedition is often a discovery and/or research trip that leads to strange and remote areas. This is by no means comparable to a classic package trip. You want to book a trip with us because we are an experienced and quality travel organization. However, you must also realize that for the type of trips we offer, some experience is expected from the travelers. You must reflect on your own capacities in advance, as well as weigh the risks of the expeditions. You must also understand that these discovery trips to remote areas come with their own risks, as they sometimes take place in extreme conditions. Even the most experienced Scandinavia, Iceland, and Antarctica experts, Africa (this also applies to many other countries), can still be surprised by the extreme conditions inherent to the regions. Yankho – 4everconnected cannot be held liable for the consequences of these unforeseen events and circumstances (e.g., avalanches, snowstorms, floods).

 

Liability
1. Yankho – 4everconnected is not liable for costs resulting from delays in transport due to weather conditions, defects, strikes, war, changes in schedule, or means of transport.

2. This text was prepared based on information known to us up to six months before its publication. If changes occur in operation, facilities, and services of the offered products, these will be communicated to the travel agent or customer immediately after becoming known by the travel organizer.

3. Yankho – 4everconnected is not liable for the death or personal injury of one of its travelers.

4. Insofar as Yankho – 4everconnected does not itself provide the services included in the travel contract, it limits its liability for material damage and compensation for the deprivation of travel enjoyment to twice the travel sum, in accordance with art. 19, §5 of the Travel Contracts Act.

 

Travel Insurance
No travel insurance is included in the total travel sum. Inquire about the cost of this insurance at booking, and we will help you further.
